According to the petitioners, they are serving on daily wages in Forest Department between the year 2015-2020. According to them, they are entitled to minimum of pay scale, however, that benefit is not being given to them. 4. Learned State Counsel, however, submits that petitioners are engaged through a private outsourcing agency, namely Global Computer Society, Nainital to meet the exigencies of work and there is no relationship of master and servant between Forest Department and the petitioners. 5. Learned counsel for the petitioners, however, submits that other similarly situate persons are being paid minimum of pay scale. 6. Learned State Counsel submits that if what learned counsel for petitioners submits is correct, then petitioners can approach the competent authority by making representation. 7. The writ petition is, accordingly, disposed of by permitting the petitioners to make representation(s) to the competent authority. If petitioners make representation, within two weeks from today, decision thereupon shall be taken, as per law, within three months thereafter.
