Learned advocate for the petitioner submits that the petitioner is in custody since 15th June, 2024 and there has been no recovery from the present petitioner. It has been brought to the notice of this court that two other accused have been granted bail being [Dhiraj Yadav @ Dhiraj in SLP (Crl.) No. 3954 of 2026 and Ankit Kumar in SPL (Crl.) 6984 of 2025]. Learned advocate, therefore, prays that the present petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail. I have taken into account the submissions of the State as well as the petitioner and also undergone the order passed by the learned Special Court in seisin of the case. 2 However, I find that an application under section 311 of the Cr.P.C. has been filed before the learned jurisdictional Special Court and, the tenor and spirit of such application is for reopening whole of the case. Conjoint effort of accused persons is reflected for delaying the examination of prosecution’s witnesses. So far as the present petitioner is concerned, the present petitioner is having previous antecedents and is carrying out the activities relating to drugs and psychotropic substances within the State of West Bengal, although, he happens to be a resident of Uttar Pradesh. Learned advocate for the State again submits that there are specific accusations so far as the present petitioner is concerned in connection with Dhubulia PS Case No. 99 of
2024. Having considered that the petitioner has antecedents and he is involved in similar other cases associated with the NDPS Act, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1660 of 2026 is dismissed.
