ORAL ORDER

1. The complainant has filed the present complaint alleging willful disobedience of the order dated 29.09.2023 passed by the learned Single Judge of this Court in Writ Petition No.18470/2023 (KLR-RR/SUR). The writ petition was disposed of by the said order observing that the complainant was required to submit an online application for phodi in terms of the Circular dated 15.10.2022. It was further directed that, on such an application being made, the authorities shall consider and dispose of the same in accordance with the seniority of the application.
2. The learned Additional Government Advocate appearing for the accused has filed a compliance affidavit, inter alia, stating that, on receipt of the order, verification was conducted and it was found that the land measuring 1 acre and 35 guntas falling in Survey No.78 of Kukkanahallil Village, Dasanapura Hobli, Bengaluru North Taluk [subject land] was registered in the name of the complainant. It was further found that the subject land falls within

an 18 kilometers radius of the jurisdictional limits of the Bruhat Bengaluru Mahanagara Palike [BBMP]. According to the authorities, the subject land could not have been granted, therefore, a case has been registered before the Assistant Commissioner under Rule 108 (K) of the Karnataka Land Revenue Rules, 1966 [KLR Rules]. It is further stated that an interim order dated 28.04.2026 staying the grant has also been passed.
3. In view of the above, we are unable to accept that there is any willful disobedience of the order dated 29.09.2023. The complaint is accordingly closed.
4. The pending interlocutory application also stands disposed of.
