Kausik (Allowed) CRM (A) 1773 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Khandaghosh Police Station Case No. 136/2026 dated 13.05.2026 under sections 126(2)/308(2)/3(5) of the BNS, 2023. And In the matter of : Sajahan Mondal & Ors. ……Petitioners. Mr. Uttiya Ray Mr. Atish Santra ……for the Petitioners. Ms. Priti Kar Bagchi ….for the State. Learned advocate appearing for the petitioners submits that petitioners have been implicated because of political vendetta. Learned advocate for the State opposes the prayer for bail and submits that the petitioners by use of force snatched/extorted amount of Rs. 2 Lakhs from the defacto complainant. I have taken into account the time frame referred to in the complaint and till date police authorities have not collected any supporting documents. 2 Having considered the same, I am of the opinion that custodial detention of the present petitioners may not be warranted. Accordingly, prayer for anticipatory bail of the petitioners are allowed. As such, I direct that in the event of arrest, the petitioners namely, (1) Sajahan Mondal, (2) Ashis Dutta, (3) Kartick Malik @ Kartick Malick, (4) Ratan Kumar Bej @ Ratan Chandra Bej, (5) Hakim Sk @ Sekh Hakim @ Hakim Sekh be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress petitioners shall report to the Investigating Officer within a period of 10 days and on all subsequent dates fixed by the Investigating Officer. The Investigating Officer would monitor the conduct of the petitioners further within the jurisdiction of the local police station and if required submit a report to the jurisdictional ACJM for violation of any conduct or breach of any peace or tranquility in the area. Learned ACJM under these circumstances would impose directions to stay outside the precincts of Khandaghosh Police Station. With the aforesaid observations CRM (A) 1773 of 2026 is allowed. 3 Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
