JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in CC No.8961 of 2017 registered for the - 3 - HC-KAR CNR: KAHC010548862026 NC: 2026:KHC:41927 CRL.P No. 11943 of 2026 offences punishable under Sections 506, 341, 34, 504, 448, 323 of IPC. 2. Heard Sri R Madhu, learned counsel appearing for the petitioners, Smt M M Waheeda, learned High Court Government Pleader appearing for respondent No.1, Sri M Venkatachalapathi, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows: "JOINT AFFIDAVIT FOR COMPROMISE UNDER SECTION 482 OF CR.P.C. CORRESPONDING SECTION OF 528 R/W 359 OF THE BHARATIYA NAGARIK SURAKSHA SANHITHA, 2023 "The petitioner and the victim in the above case most humbly file the following joint compromise memo for compounding the offences. 1. The petitioners herein are facing trial in Crime No.109/2026 of Jalahalli Police Station, which after investigation has culminated in C.C.No.8961/2017, for the offences punishable under Sections 506, 341, 34, 504, 448, 323 of IPC, and the same is presently pending on the file of the Hon'ble 49th Additional Chief Judicial Magistrate, Bengaluru. - 4 - HC-KAR CNR: KAHC010548862026 NC: 2026:KHC:41927 CRL.P No. 11943 of 2026 2. It is submitted that, due to the intervention of elders, well wishers, and family members of both parties, the dispute between the petitioners and the complainant has been amicably settled, the parties have resolved their differences and have decided to live peacefully, and the complainant has no objection for compounding/quashing of the case and does not wish to prosecute the present case any further. 3. The petitioners and the complainant respectfully submit that this Hon'ble Court may kindly read the averments made in the main petition as part and parcel of this affidavit, to avoid repetition. WHEREFORE, the petitioners and the complainant most humbly pray that this Hon'ble Court be pleased to accept this Joint Affidavit of Compromise and permit compounding/quash the proceedings in Crime No.109/2016 culminating in CC No.8961/2017 pending on the file of the Hon'ble 49th Additional Chief Judicial Magistrate, Bengaluru, in the interest of justice and equity." 4. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition stands disposed. - 5 - HC-KAR CNR: KAHC010548862026 NC: 2026:KHC:41927 CRL.P No. 11943 of 2026 (ii) Proceedings pending in CC No.8961 of 2017 pending before the 49th Additional Chief Judicial Magistrate, Bangalore, against the petitioners stands quashed.
