1. Writ petition is heard along with application being CAN 1 of 2026. 2. In the writ petition prayer is made to restrain others from initiating frivolous and vexatious criminal prosecution against the petitioner. However, during pendency of this writ petition one criminal prosecution was initiated based on FIR being Dinhata Police Station Case No. 497 of 2026 dated 8th July, 2026 which prompted the petitioner to approach this Court with the present application being CAN 1 of 2026 thereby seeking direction not to proceed with the aforesaid criminal prosecution. 3. During course of hearing Mr. Bandopadhyay, learned advocate representing petitioner submits that one pre-arrest bail application was moved before Circuit Bench at Jalpaiguri
2 in connection with Dinhata Police Station Case No. 497 of 2026 dated 8th July, 2026 and an interim protection was granted by a coordinate bench on 30th July, 2026. Copy of the order dated 30th July, 2026 passed on CRM(A) 532 of 2026 is placed before this Court and same is taken on record. 4. On perusal of such order dated 30th July, 2026 it appears that petitioner is protected for a limited period in connection with Dinhata Police Station Case No. 497 of 2026 dated 8th July, 2026. Therefore, no further order need be passed on this writ petition and application so far said criminal prosecution is concerned. 5. However, from the submission made on behalf of petitioner it appears that there might be other criminal prosecutions pending against the petitioner apart from Dinhata Police Station Case No. 497 of 2026 dated 8th July,
2026. 6. Deputy Inspector General of Police (Legal), West Bengal is directed to intimate the petitioner number of criminal prosecutions pending against the petitioner as on date apart from Dinhata Police Station Case No. 497 of 2026 dated 8th July, 2026 by 10 days from date. 7. Writ petition and connected application being CAN 1 of 2026 are disposed of. If any other
3 connected application is pending same also stands disposed of in view of order passed today. 8.
This order shall not preclude the petitioner to take steps in accordance with law, if petitioner is informed of pendency of other criminal prosecutions. 9. Leave is granted to the learned advocate for the petitioner to amend cause title of the writ petition and array Deputy Inspector General of Police (Legal), West Bengal as additional respondent in course of this day. However, service of notice upon additional respondent stands dispensed with since State respondents are represented by Mr. Suryaneel Das, learned Additional Government Pleader.
