Learned advocate appearing for the petitioners submits that petitioner is innocent and there was a case and counter- case over a property dispute.
Learned advocate for the State opposes the prayer for anticipatory bail, draws the attention of the Court to the injury report as well as the statement of the victim.
I have taken into account the statements of the injured as well as the injury sustained. Having considered the same, I
2 am of the view that so far as petitioner no. 2 namely, Sk Tahajul Hosen @ Sk Tahajul Hossain is concerned, his prayer for anticipatory bail should be rejected.
So far as petitioner no. 1 namely, Ohida Bibi is concerned, her prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner namely, Ohida Bibi be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge sheet has already been submitted, the prayer for anticipatory bail of petitioner no. 1 will be valid for a period of 6 weeks. Accordingly, CRM (A) 2729 of 2026 is allowed. Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
