JUSTICE D K SINGH) The present writ petition has been filed under Article 227 of the Constitution of India impugning the order dated 19.02.2026 passed by the Karnataka Land Grabbing Prohibition Special Court, Bengaluru, (CH-2) in LGC(P) No.1105/2017 2. Vide impugned order the application filed by the petitioner under Section 9(3) of the Karnataka Land Grabbing Prohibition Act, 2011 R/w Section 151 of CPC has been rejected. However, direction has been issued to the Joint Commissioner, Bengaluru South City Corporation, Bengaluru and Commissioner, BDA, Bengaluru, to submit status report with regard to allegations made in the complaint, as to whether there is an encroachment - 3 - HC-KAR CNR: KAHC010277472026 NC: 2026:KHC:43976-DB WP No. 12538 of 2026 of public road as alleged in the complaint, if there is an encroachment, nature of the encroachment, extent of the encroachment, name and address of the alleged encroachers along with survey sketch, approved layout plan on the next date of hearing. 3. We are of the view, that if the report as directed by the Land Grabbing Court vide impugned order suggests that the petitioner has not encroached upon the government land, the case against the petitioner should be closed and he should be discharged. All would depend on the report to be submitted by the concerned authorities as directed vide impugned order passed by the Land Grabbing Court and therefore, at this stage, we do not want to interfere with the proceedings before the Land Grabbing Court. However, we make it clear that if the report as directed by the Land Grabbing Court suggests that petitioner has not encroached upon the Government Land / Public Land, the proceedings should be dropped against the petitioner. - 4 - HC-KAR CNR: KAHC010277472026 NC: 2026:KHC:43976-DB WP No. 12538 of 2026 4.
