This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 2nd Court at Barasat, North 24 Parganas, to dispose of the Title Suit no. 749 of 2022, expeditiously. From the order sheets appended to this application, this Court finds that 27th November, 2026 is fixed for acceptance of show cause filed by the plaintiff. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 2nd Court at Barasat, to take up the hearing of the issue of acceptance of the show cause filed by the petitioner on the next date fixed i.e. 27th November, 2026 and to dispose of such issue on that date itself and if the issue of show cause is decided in favour of the plaintiff, the learned trial judge shall make an endeavour to proceed with the suit
2 in accordance with law and shall make an endeavour to dispose of the Title Suit no. 749 of 2022 as expeditiously as possible without granting any unnecessary adjournments to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
