1. Mr. Shivam Gulati, learned counsel for the petitioners.
2. Mr. B.C. Joshi, learned A.G.A. for the State.
3. The petitioners Soniya and Sagar Kumar are praying for protection to their life and liberty since there is a regular threat from respondent nos. 4 to 6 who are real brothers of petitioner no. 1.
4. It is contended in the petition that both the petitioners are major and married with each other on 22.04.2024 at Shiv Mandir and their marriage is also registered on 08.07.2024. It is further contended that a representation was made to the S.S.P. Haridwar with regard to the threat which they have received from respondent nos. 4 to 6.
5. This Court interact with both the petitioners and they submit that they are major. The marriage registration certificate is also enclosed.
6. Mr. B.C. Joshi, learned A.G.A. for the State have not disputed their age as well as their marriage.
7. Since, petitioners already submitted representation before the S.S.P. Haridwar on 17.04.2026, and both of them are major and married with each other, therefore, the State agency is under legal obligation to make an assessment of threat perception if any.
8. In such view of the matter the instant writ petition is disposed of finally with the direction to the S.S.P. Haridwar to assess the threat perception of the petitioners from respondent no. 4 to 6 and if he comes to the conclusion that there is a threat perception take appropriate steps. In addition to this the S.H.O. concerned shall also call upon respondent nos. 4 to 6 and advise them not to take law in their hands.
