This application under Article 227 of the Constitution of India is at the instance of the claimant praying for a direction upon the learned Additional District Judge, 3rd Court at Barasat to dispose of the Land Acquisition Execution Case No. 06 of 2019 expeditiously. From the order-sheets appended to this application this Court finds that January 30, 2026 was fixed for making payment. Considering the fact that the execution case is pending from the year 2019, this Court feels that ends of justice would be sub-served if the executing court is directed to dispose of the execution case expeditiously. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be
2 obliged to forward a copy of this application along with a server copy of this order, upon the opposite parties or upon the learned advocate representing them before the Executing Court forthwith. In the light of the submission made by the learned advocate appearing for the petitioners, this civil revision application stands disposed of by requesting the learned Additional District Judge, 3rd Court at Barasat to dispose of the LA(Ex) No. 06 of 2019 as expeditiously as possible without granting any unnecessary adjournment to either of the parties, keeping in mind the observations made by the Hon'ble Supreme Court in the case of Rahul S. Shah – Vs.- Jitendra Kumar Gandhi, reported at (2021) 6 SCC 418 and Bhoj Garg –Vs.- Goyal Education & Welfare Society & Ors., reported at 2025 INSC 329.
