JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in Crime No.144 of 2026 registered at Kothanur Police Station, for the offences punishable under Sections 115(2), 127, 351(2), 352, 74, 75, 78 read with 3(5) of BNS, 2023. 2. Heard Sri M Udaya Kumar, learned counsel appearing for the petitioners, Smt M M Waheeda, learned High Court Government Pleader appearing for respondent No.1, Smt M Veenakumari, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows: - 4 - HC-KAR CNR: KAHC010510352026 NC: 2026:KHC:40092 CRL.P No. 11149 of 2026 "JOINT AFFIDAVIT We, BattvlaKeerthi, D/o Sathyanarayana, Aged about 28 years, R/at: 54, A Narayanapura, Uday Nagar, Bengaluru.560 019,Suresh.G. S/o GovindRaj.P. Aged about 34 years, R/at No.32, Muneshwara Temple Road, Sriramapura, Jakkur, Bengaluru-56 Vasudeva s/o AnandBabu, Aged about 29 years, Presently residing at ThirumenahalliMain Road, 3rd Cross, Near KNS Institute, Bengaluru Permanently R/at 1-751, Christian Colony, Kadri Post, Kadri Anantapuramu, Andhra Pradesh-515591, Suvasree Paramanik, W/o SubirParamanik, Aged about 26 years, R/at No.474, 1st Floor, 3rd Cross, Maruthinagar, Yelahanka, Bengaluru, do hereby solemnly affirm and state on oath as follows:- 1. I the deponent No.1 is the complainant/1st informant/respondent No.2 in the above case. The deponent No.2 to 4 is the accused/ petitioners in the above case. We the petitioners and respondent No.2 are well acquainted with the facts and circumstances of the said case. 2. We state that the respondent No.1 has registered a case against the petitioners for the offence punishable under sections 115(2), 127, 351(2), 352, 74, 75, 78 R/w 3(5) of Bharatiya Nyaya Sanhita 2023, based on the complaint filed by the respondent No.2 on 21/04/2026. 3. We state that, at the intervention of elders and well-wishers we have amicably settled the matter among ourselves. The respondent No.2 has no objection to compound the offence and to quash the FIR against the petitioners from the said case. 4. We state that, the matter has been settled amongst ourselves voluntarily without coercion, threat or fraud. As such continuance of investigation on FIR in Crime No.144/2026 would be futile excise and as such the respondent No.2 has no objection for quashing the FIR against the petitioners. - 5 - HC-KAR CNR: KAHC010510352026 NC: 2026:KHC:40092 CRL.P No. 11149 of 2026 5. The 1st informant/2nd respondent has no grievance remaining against the petitioners/accused and has no objections to the compounding offence and acquittal of the petitioners/accused. WHEREFORE, we respectfully pray that this Hon'ble Court may be pleased to take this joint affidavit on record and permit the compounding of offence pursuant to the FIR and quash investigation in Crime.No.144/2026 for prosecuting the petitioners under sections 115(2), 127, 351(2), 352, 74, 75, 78 R/w 3(5) of Bharatiya NyayaSanhita 2023, pending on the file of XXIX Addl Chief Judicial Magistrate at Bengaluru, registered by the Kothanur Police station with the permission of this Hon'ble court, in the Interest of Justice. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. (ii) Proceedings pending in Crime No.144 of 2026 registered at Kothanur Police Station, pending before the XXIX Additional Chief Judicial - 6 - HC-KAR CNR: KAHC010510352026 NC: 2026:KHC:40092 CRL.P No. 11149 of 2026 Magistrate Court, Bangalore, against the petitioners stands quashed.
