1. Learned Advocate for the petitioners submits that the victim has been recovered and that there has been a subsequent development in the case. He further submits that both families have now agreed to accept the relationship between petitioner no. 1 and the victim, and that immediately after the victim attains the age of majority, the marriage will be arranged.
2. Learned Advocate for the State produces the case diary and opposes the prayer for anticipatory bail. He submits that the victim is yet to attain the age of majority.
3. Victim and her mother are present in Court, and the de facto complainant is being represented through Ms. Khatun. She also submits that immediately after the victim attains majority, the marriage ceremony will be arranged, as has been decided by the members of both parties.
4. Heard the learned advocate for the respective parties and perused the materials on record. Noting the subsequent development of
2 the case and in the greater interest of justice, I am of the view that it would be apposite to extend the benefit under section 482 BNSS in favour of the petitioners.
5. Accordingly, I direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- each with two sureties of like amount each, to the satisfaction of the learned judge, Special Court under POCSO Act, Diamond Harbour and also subject to the conditions as laid down under section 482(2) of BNSS 2023.
6. The application being CRM (A) 2140 of 2026 is disposed of.
