Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 1½ months and the subject matter of the case relates to alleged recovery of 73 bottles of codeine phosphate. However, no recovery has been made from the petitioner and the petitioner has been implicated on the basis of the statement of the co-accused. Learned advocate for the State opposes the prayer for bail. On a specific query learned advocate for the State submits a report. Report submitted before the Court do not reflect previous antecedent or call detail records or money trail connected with the present petitioner so far as present case is concerned. Having considered the fact that the petitioner’s 2 implication is based on statement of the co-accused, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Md. Masud Ali @ Masud shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1728 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
