JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking the following prayers: "WHEREFORE, the petitioner who is arrayed as accused No.1, humbly prays, that this Hon'ble Court be pleased to quash the entire proceedings in Spl.C.C.No.876/2025 (Crime No.16/2022) registered by the Rajajinagar P.S, Bengaluru, for the offence punishable under Sections 354, 504, 506 r/w S.149 of IPC and Sections 3, 3(1)(e), S.3(1)(h) & S.3(1)(r) of the SC/ST (POA) Act, pending before the Hon'ble LXX Addl. City Civil & Sessions Judge & Spl. Judge, Bengaluru (CCH-71), in the interest of justice." - 3 - HC-KAR CNR: KAHC010480622026 NC: 2026:KHC:42381 CRL.P No. 10395 of 2026 2. Heard Sri.M.R.C Manohar, learned counsel appearing for the petitioner, Smt.Deepthi Alva, learned HCGP appearing for respondent No.1, Sri.S.Doreraju, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “I, Binod Kumar Bimal, S/o Kamleshwari Prasad, Aged about 48 years, R/at, No.C-05, Panchdeep Nikunj, Near Bima Hospital, Nanda Nagar, Madhya Pradesh-452 011, now at Bengaluru & Smt. Menaka, W/o Late Sampangi, Aged about 48 years, R/at, No.73, Anandapura, Chamrajpet, Bengaluru-560 018, do hereby solemnly affirm and state on oath as follows: 1. WE submit that, Binod Kumar Bimalis the Petitioner/A-1 & Smt. A Menaka is the 2nd Respondent in the above case. 2. It is submitted that, on 11/02/2022, the 2nd Respondent, has filed a Complaint before the Respondent No.1/Police. Based on the above Complaint, the Respondent No.1/Police have registered a case in their Crime No.16/2022, for the offences punishable u/S. 354, 504, 506, 509 r/w S.149 of IPC and S.3, 3(1)(e), S.3(1)(h) & S.3(1)(r) of the SC/ST (POA) Act, against me & others, pending before the Hon'ble LXX Adl. City Civil & Sessions Judge & Spl. Judge, Bengaluru (CCH- - 4 - HC-KAR CNR: KAHC010480622026 NC: 2026:KHC:42381 CRL.P No. 10395 of 2026 71). The Petitioner has been arrayed as Accused No.1 in the above case. 3. It is submitted that, the Respondent No.1/Police have Investigated the above Complaint filed by the Respondent No.2 & filed B-report twice i.e., on 18/08/2022 & 24/11/2023. However, the learned Trial Court has taken cognizance & directed the office to register a Special Case No.876/2025 against the Petitioner & Others, vide Order dt: 15/04/2025. 4. We submit that, the Accused No.2/Tharanath.D.M has filed a complaint against the 2nd Respondent & Ors. in C.C.No.31924/2022, pending on the file of the II ACJM, Bengaluru and the same is pending consideration. The Petitioner & A-2 undertake to co-operate with the Respondent No.2 to close the said proceedings by appearing before the Hon'ble High Court of Karnataka and/or the Trial Court. 5. It is submitted that, the Parties have come to a conclusion to resolve the entire disputes between themselves, unconditionally and accordingly, a settlement has been arrived between the Parties. 6. It is submitted that, the criminal proceedings were initiated against the Petitioner & other Accused Persons on account of misunderstandings. However, the said misunderstandings are now resolved amicably. 7. It is submitted that, the proceedings against the Accused No.2 & 3, have also been amicably resolved & Quashed by this Hon'ble Court in Crl.P No.8407/2025 & Crl.P No.6336/20206 dt: 27/04/2026, respectively. - 5 - HC-KAR CNR: KAHC010480622026 NC: 2026:KHC:42381 CRL.P No. 10395 of 2026 8. WE submit that, the 2nd Respondent has agreed to withdraw the above case filed against the Petitioner/A-1. 9. WE Submit that, the 2nd Respondent had filed a Complaint against the Petitioner/A-1 before the 1st Respondent police and after due deliberations and advises from well- wishers, relatives & friends, the 2nd Respondent has decided not to further prosecute the case. 10. WE submit that, the 2nd Respondent has no objection for quashing the entire proceedings, against the Petitioner/A-1, in Spl.C.C No.876/2025 (Crime No.16/2022) registered by the Rajajinagar P.S., Bengaluru, for the offence punishable u/S. 354, 504, 506, 509 r/w S.149 of IPC and S.3, 3(1)(e), S.3(1)(h) & S.3(1)(r) of the SC/ST (POA) Act, pending before the Hon'ble LXX Addl. City Civil & Sessions Judge & Spl. Judge, Bengaluru (CCH-71). 11. If this application is not allowed, WE will be put to great hardship, injury and mental agony that apart leading to multiplicity of proceedings which consume lot of judicial time. Whereas, no prejudice will be caused to the prosecution if the same is allowed. WHEREFORE, it is humbly prayed that, this Hon'ble Court be pleased to allow the accompanying application as prayed for, in the interest of justice. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in Spl.C.No.876/2025 (Crime No.16/2022) pending before the LXX Addl.
