3. Petitioner has sought a mandamus to the respondents to release the amount of gratuity in his favour on the basis of last drawn salary, after counting the entire length of service.
4. Learned State Counsel points out that petitioner’s claim has been rejected, vide order dated 16.05.2023 on the ground that he has served only for one year nine months and three days; while as per the applicable provision, one should have served for minimum five years.
5. Since petitioner’s claim is rejected and he has not challenged the rejection
order, therefore, the relief as claimed cannot be granted.
6. The writ petition is, accordingly, dismissed. Petitioner, however, shall be at liberty to challenge the rejection order before appropriate forum.
