Heard Ms. N.J. Das, learned counsel appearing on behalf of Mr. N. Nath, learned engaged counsel for the petitioner. No one has represented the respondent side.
Page No.# 2/2 From the order dated 10.01.2024, passed by this Court, it is seen that the order of issuance of proclamation was kept in abeyance for thirty (30) days which was under challenge with a further direction to the petitioner to appear before the learned Trial Court below within fifteen days from the date of order. It is submitted by Ms. Das, the learned counsel for the petitioner that after the order dated 10.01.2024, the petitioner immediately appeared before the learned Trial Court below, his bail prayer was granted and the case was proceeding at this stage. The case is at the evidence stage at present and the case is fixed on 06.03.2026, for cross-evidence of the PW.1. Accordingly, she submitted that the matter has become infructuous and prayed for disposal of the same. Considering the submission made by learned counsel for the petitioner and also in view of the order dated 10.01.2024, the petitioner has already entered appearance in the learned Trial Court below, whose appearance is accepted and the case is proceeding at present. Considering this aspect of the case, the prayer for disposal made by the learned counsel appearing on behalf of the petitioner is hereby accepted and accordingly the matter is disposed of as rendered infructuous.
