This is an application under Section 528 of the BNSS, 2023 in respect of NDPS Page No.# 2/2 Case No.157/2025 pending in the court of the learned Additional Sessions Judge No. 1, Kamrup (Metro) at Guwahati arising out of DRI Case No.24/CL/NDPS/METH/DRI/ GZU/2024-25. 3. The petitioner has been shown as absconder in a charge sheet. He now apprehends that if he appears before the trial court, he will be remanded to custody. 4. The learned counsel for the petitioner submits that the petitioner intends to face the trial and therefore, he may be given one opportunity to that effect. 5. It may be mentioned that the trial court has issued NBWA against the petitioner. 6. I have considered the submissions made by the learned counsels of both sides. 7. Since the petitioner is interested in facing the trial, he deserves to be given an opportunity to that effect. Therefore, his Criminal Petition is allowed. 8. The NBWA issued against the petitioner shall be recalled. 9. It is hereby directed that the petitioner Samsul Haque shall appear before the court of the learned Additional Sessions Judge No. 1, Kamrup (Metro), Guwahati in connection with NDPS Case No.157/2025 within next 10 days from today. On his appearance, the petitioner shall be released on bail of ₹50,000/- with a surety of like amount to the satisfaction of the learned trial court.
