Pursuant to the earlier direction, the Inspector-in- charge, Serampore Police Station is present before this court with a fresh report. The report depicts that only three more witnesses are left to be examined by the prosecution which includes handwriting expert, fingerprint expert and the Investigating Officer of the case. Having considered the advanced stage of the case, I am of the opinion that an opportunity must be granted to the prosecution since the case was registered under section 302/202 of the IPC. As such, within a period of six months from the date fixed before the learned trial court, the prosecution will complete the evidence of rest (three) of the witnesses.
2 However, considering the stage of the case, inspite of the period of detention of the present petitioner, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. This order be communicated through the Inspector- in-charge of Serampore police station to the learned trial court within a week from date and the learned trial court would be at liberty to reschedule the fixed date including pre-ponment of the date already fixed. Accordingly, CRM (M) 985 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Report submitted be kept with the record. The Inspector-in-charge of Serampore Police Station is present in court today. His further appearance before this court for the day is dispensed with. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta, Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
