The petitioner is aggrieved that his candidature for the post of Constable in Central Armed Police Force has been rejected on the medical ground that he suffers from “scoliosis”. 2. Mr. Mukherjee, learned Advocate appearing for the petitioner, has placed reliance of a examination report obtained from the NRS Medical College and Hospital, whereby it is found that the petitioner suffers from “mild scoliosis”. This finding of the NRS Medical College and Hospital is on similar lines with the finding of the Review Medical Board. 3. Both reports have returned to a finding that the petitioner suffers from scoliosis. The only difference between two reports is that while the Review Medical Board holds the petitioner to be unfit on such ground, the NRS Medical College and Hospital report for obvious reasons, which is a civil hospital dealing with the civilians, has held the petitioner not to have any functional limitation. 2 4. In view of the afore-stated, the concerned authority is directed to reconstitute a Review Medical Board to examine the petitioner and if found with scoliosis, to come to a finding whether the nature of the ailment would be a disabling factor for the petitioner to discharge his duties as a Constable in Central Armed Police Force. 5. The entire exercise should be completed by October 31, 2026 and the resultant order should be communicated to the petitioner within a week thereafter. 6. With the afore-stated directions, the writ petition is disposed of. 7. There shall, however, be no order as to costs. 8.
