The first bail application of the applicant was dismissed on merits on 23.9.2025 in M.Cr.C. No. 7655 of 2025. The applicant has preferred this Second Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in NIRMALA RAO
2 connection with Crime No.1/2025, registered at Police Station Chilfi, District – Kabirdham (C.G.) for the offence punishable under Section 20(B)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act,
1985. 2) The case of the prosecution, in brief, is that the police of Police Station Chilfi received secret information from an informant and, acting upon the said information, conducted a raid and seized 34.420 kg of contraband ganja from the possession of the applicant and co-accused Shrawan Kumar. Thereafter, the aforesaid offence was registered against the applicant. 3) Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. She would further submit that the applicant is in jail since 1.1.2025 and conclusion of the trial is likely to take quite long time. Therefore, she prays for grant of regular bail to the applicant. 4) On the other hand, learned counsel appearing for the State/non- applicants would oppose the bail application and submit that 34.420 kg of ganja was seized from the possession of the applicant. He would further submit that three criminal antecedents are pending against the present applicant, two of which are registered in the State of Rajasthan and one in the State of Chhattisgarh. Therefore, the bail application of the applicant deserves to be dismissed. 5) I have heard learned counsel appearing for the parties and perused the case diary.
6) Having considered the fact that the first bail application of the applicant was dismissed on merits vide order dated 23.9.2025 and that,
3 subsequently, the SLP filed on behalf of the applicant was withdrawn, and further considering the quantity of contraband seized from the possession of the applicant and the other co-accused, i.e., 34.420 kg, as well as the fact that three criminal antecedents are pending against the present applicant, two of which are registered in the State of Rajasthan and one in the State of Chhattisgarh, this Court is of the view that the applicant is not entitled to be released on bail in this case. 7) Accordingly, the second bail application filed by applicant is dismissed.
