1. By the present writ petition, the petitioners are seeking for the following reliefs :-
“1) This Hon'ble Court may kindly be pleased to issue similar direction as has been issued in W.P.S. No. 697/23 by this Hon'ble Court in its order dated 11.07.2024 (Annex. P-1) in the interest of justice or in alternative. 2) That to issue an appropriate order / direction to the respondent No. 3 CIDC to decide the representation dated 14.07.2026 Annex. P-3 by taking into

consideration the orders / directions issued by this Hon'ble Court in W.P.S. No. 697/2023 within a time frame in the interest of justice. 3) Any other writ or direction which the Hon'ble Court may deem fit and proper under the facts and circumstances of the case may also be issued. The Hon'ble Court may further be pleased to allow the cost of the petition in favour of the petitioner.”

At the outset, learned counsel appearing for the parties would jointly and fairly submit that the issue involved in this writ petition has already been considered and decided by this Court vide order dated 11.07.2024 passed in WPS No.697 of 2013 and other connected matters, wherein this Court held as under:-
“6. Though a decision has been taken vide letter dated 02.03.2012 by the State Government not to make payment of arrears of the revised pay-scale to the employees from 01.01.2006 to 31.10.2011, no reason has been assigned in this regard. The decision appears to be unreasonable, unfair, discriminatory and violative of Articles 14 and 21 of the Constitution of India.
7. Taking into consideration the law laid down by the Hon’ble Supreme Court in the matters of Bihar State Beverages Corpn. Ltd. (supra) and Satya Brata Chowdhury (supra) and considering the fact that no reason has been assigned by the State in Circular dated 02.03.2012, and the same is hereby quashed.
8. As the Circular dated 02.03.2012 has already been quashed meaning thereby the petitioners would be entitled to get the benefit of the 6th pay commission and other revisions of salary from 01.01.2006 till
31.10.2011. Thereafter, the State Authorities are
directed to calculate the amount of arrears of salary of the petitioners and to make payment and decide the representation subject to verification of the amount claimed by the petitioners preferably within a period of 150 days from the date of receipt of a copy of this
order.

9. With the aforesaid observation(s) and direction(s), this petition is allowed, subject to verification of the
facts.”

Learned counsel would further submit that since the facts and issue involved in the present case is identical to that of WPS No. 697 of 2013 and other connected matters, this petition may also be decided in the same terms.

Having considered the submissions made by learned counsel for the parties; particularly considering the relief sought for by the petitioners and having gone through the materials available on record, it is evident that the facts and issue involved in this petition is identical to WPS No. 697 of 2013 and other connected matters, this Court deems it appropriate not to take a view other than what has been taken in the aforesaid batch of writ petitions.
5. Accordingly, the present petition is allowed in terms of the order dated 11.07.2024 passed in WPS No. 697 of 2013 and other connected matters. Sd/- (BIBHU DATTA GURU)
