1. Heard Ms. KLR Yanthan, learned counsel for the petitioner.
2. By order dated 01.12.2015 passed in WP(C) No. 2395/2011, the ministerial staff serving in the office of Chemical Examiner (Excise) and Joint Commissioner of Excise are directed to be treated as part of the ministerial staff of the establishment of Commissioner of Excise and accordingly further direction was issued to prepare a common gradation list of the ministerial staff, cadre wise and thereafter to consider the case of the petitioner for promotion beyond UDA (Senior Assistant) with his junior and if he was found eligible for such promotion, notional promotion was directed to be given.
3. The aforesaid order was affirmed by the Division Bench in WA No. 191/2017 under its order dated 07.11.2022. Subsequently, another Contempt Petition was filed, registered as Cont.Cas(C) 266/2023 assailing non-compliance of the order. However, said contempt petition was closed by the Division Bench under its order dated 20.02.2024 recording that there are substantial compliance of the order dated 01.12.2015 passed in WP(C) No. 2395/2011.
4. In view of the aforesaid, the present contempt petition stands closed. JUDGE Comparing Assistant
