Following reliefs have been prayed in this petition:- “10.1 May, this Hon'ble Court kindly be pleased to direct the Respondent no.2 to correct the Petitioner's date of birth in the marksheet/certificate of Class X as 27.08.2005 as per the annexed Birth Certificate. 10.2. May, this Hon'ble Court may kindly be pleased to direct the Respondents to issue fresh/corrected Class X certificate reflecting the correct date of birth as 27.08.2005 as per the birth certificate. 10.3. May, this Hon'ble Court may kindly be pleased to direct the Respondents to make the necessary correction in all their records and databases relating to the Petitioner. 10.4 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deem fit. 10.5 Cost of the petition may also be awarded.” 2. Learned counsel for the petitioner submits that the petitioner's actual date of birth is 27.08.2005, which is supported by her Birth Certificate and other documents. It is submitted that the date of birth has inadvertently been recorded as 28.08.2005 in the Class X 3 marksheet/certificate and that the petitioner is seeking only correction of the erroneous entry. 3. Learned counsel appearing for respondent No.2 submits that the claim for correction of date of birth has been raised after an inordinate and unexplained delay and is, therefore, liable to be rejected on the ground of limitation/laches in terms of the applicable rules and procedure governing correction of entries in the records of the Board. It is stated that according to rules, the correction in date of birth can only be done within three years of publication of result. 4. Having heard learned counsel for the parties and having considered the material available on record, this Court finds that the petitioner seeks correction of the date of birth recorded in her Class X marksheet/certificate after considerable lapse of time. The statutory procedure prescribed for seeking such correction cannot be invoked after an inordinate delay so as to unsettle the academic records at such a belated stage. 5. The fact that the petitioner relies upon certain documents showing her date of birth as 27.08.2005, by itself, does not entitle her to seek correction of the date of birth in the Class X records after expiry of the prescribed period. The question whether the entry can be corrected at this stage is governed by the applicable rules and the limitation prescribed thereunder. 4 6. In view of the aforesaid, this Court is not inclined to exercise its extraordinary jurisdiction under Article 226 of the Constitution of India for entertaining the belated claim for correction of date of birth. The writ petition is accordingly dismissed on the ground of delay and limitation/laches. 7. It is made clear that this Court has not expressed any opinion on the genuineness or otherwise of the documents relied upon by the petitioner or on the correctness of the date of birth claimed by her. sd/- (Amitendra Kishore Prasad) Judge Vishakha
