2026:HHC:13539 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA. CMP(M) No. 318 of 2026 Date of decision: 24.04.2026 Surender Kumar …Petitioner Versus State of H. P. & Ors. …Respondents Coram The Hon’ble Mr. Justice G. S. Sandhawalia, Chief Justice. The Hon’ble Mr. Justice Jiya Lal Bhardwaj, Judge. Whether approved for reporting? For the Petitioner: Mr. Dushyant Dadwal and Mr. Sashwat Dadwal, Advocates. For the Respondents: Mr. Pranay Pratap Singh, Additional Advocate General, for respondents NO. 1 and 2. G. S. Sandhawalia , Chief Justice (Oral) The present review petition seeks consideration of order passed in LPA No. 447 of 2024, titled as Surender Kumar vs. State of H.P. & Ors., decided on 15.10.2025. 2. The review is apparently based on an information, which was sought subsequently to the passing of the order by filing an application under Right to Information on 06.12.2025 and the information was accordingly supplied on 24.01.2026 and is thus barred by 100 days. 3. It is, thus, apparent that by seeking review, the petitioner is placing additional material on record to supplement 2 2026:HHC:13539 and re-argue the matter. It is, thus, not within the purview of the review Court. 4. Similarly, the matter is now being argued by the counsel, who was not original counsel in the appeal and the Hon’ble Apex Court has deprecated the practice of changing the counsel while filing of review petitions as per the law laid down in Tamil Nadu Electricity Board & Anr. vs N. Raju Reddiar & Anr., AIR 1997 SC 1005. 5. In such circumstances, we do not find it a fit case to review the earlier order. Accordingly, we dismiss the application for condonation of delay and so also the review petition. Pending applications, if any, also stand disposed of. (G. S. Sandhawalia) Chief Justice (Jiya Lal Bhardwaj) 24th April, 2026(sanjeev) Judge
