Learned senior advocate appearing for the petitioner submits that the petitioner is in custody from 18.12.2025; although case was registered under Sections 85/80/103 of the Bharatiya Nyaya Sanhita, 2023, but subsequently charge-sheet has been submitted under Sections 85/80/108 of the Bharatiya Nyaya Sanhita, 2023. Petitioner is the husband who is in custody for a considerable period of time; charge-sheet has already been submitted before the jurisdictional court and the other accused persons have been granted anticipatory bail. 2 Learned advocate appearing for the de facto complainant opposes the prayer for bail and submits that the marriage was solemnized on August, 2025 and the incident happened on 18.12.2025. Learned Public Prosecutor appearing for the State has referred to the post mortem report emphasizing the injuries and the statement of the neighbours under Section 183 of the BNSS. Having regard to the injuries which are available in the post mortem report, I am of the opinion that at this stage, it would not be fit and proper to release the petitioner on bail as prima facie, prosecution has made out a strong case. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 1262 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
