M V SUBBA REDDY The Court made the following: 4 VS,J W.P.No.5301 of 2018 ORDER: This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer: “to issue a Writ, one in the nature of a Writ of Mandamus or any other appropriate Writ, Direction or Order declaring the inaction of the respondents 3 to 5 not taking action against the petitioners representation dated 20-11-2017 is illegal, arbitrary and violation and consequently direct the respondents 3 to 5 cancel the pattas illegally obtained by the respondents 6 to 10 and his family members and pass” 2. The petitioners are agriculturists and residents of Goddumarri village of Yellanur mandal, Ananthapur district and the respondent Nos.6 to 10 are all residents of Lakshmipalli village, Yellanur mandal. The 6th respondent worked as a Village Revenue Officer of Goddumarri and Lakshmipalli villages and thereafter, his son i.e. the 7th respondent got appointed as Village Revenue Officer. 3. The grievance of the petitioners is that during the tenure of respondent Nos.6 and 7 as Village Revenue Officers, they got issued D- form pattas of various extents of land in favour of respondent Nos.8 to 10 illegally by misusing their powers. Contending the same, the petitioners submitted representation dated 20.11.2017 before respondent Nos.2 to 4 requesting to initiate departmental action against respondent Nos.6 and 7, further to cancel D-form pattas issued in favour of respondent Nos.8 to 10. 5 VS,J W.P.No.5301 of 2018 As no action was initiated pursuant to the representation dated 20.11.2017, the present writ petition is filed. 4. Heard Sri. M. Karibasaiah, learned counsel for the petitioners, learned Assistant Government Pleader for Revenue and Sri. M.V. Subba Reddy, learned counsel for respondent Nos.8 to 10. 5. Today when the writ petition came up for hearing, learned Assistant Government Pleader furnished a copy of instructions of the 5th respondent vide Rc.No.B/125/2026, dated 23.06.2026 wherein it is stated that the 6th respondent possesses Acs.6.33 cents of land in Goddumarri village of Yellanur mandal who worked as Village Revenue Officer and thereafter, the 7th respondent – son of the 6th respondent became Village Revenue Officer of Yellutla village of Putluru mandal. It is further stated in the instructions that pursuant to the representation made by the petitioner, the 5th respondent has conducted a detailed enquiry and having found that the petitioner has misrepresented the facts, a detailed report was submitted to the 4th respondent for taking further action. 7. On a perusal of the said instructions, it can be observed that the 5th respondent, pursuant to a representation made by the petitioner on 20.11.2017, has conducted a detailed enquiry and also submitted a report to the 4th respondent for taking further action, but, however, no further action has been initiated in the present case. 8. In view of the same, instead of keeping the writ petition pending, this Writ Petition is disposed of and the 4th respondent is directed to initiate appropriate action pursuant to the report submitted by the 5th respondent, in accordance with law. The said process shall be completed within a period of six (6) months from the date of receipt of a copy of this order. 9. Accordingly, this writ petition is disposed of. There shall be no order as to costs.
