Heard the learned advocates for the petitioner and the state. 2. Learned advocate for the petitioner submits that the victim committed suicide. Prior to that there was a salishi meeting. The petitioner attended such meeting as an eye witness. 3. It has been alleged against the present petitioner that as he narrated the alleged incident before the salishi meeting he has been falsely implicated in this case. Page 2 4. On the other hand, learned advocate for the State relies upon the statement of the witnesses recorded under Section 180 of the BNSS as well as Section 183 thereof. 5. He also refers to the post-mortem report. 6. The post mortem report shows semicircular ligature mark in and high around the neck. 7. According to the autopsy surgeon the death was due to effect of hanging. 8. Having heard the learned advocates for the parties and after going through the materials in the case diary, it appears that the victim committed suicide by hanging. 9. It has been alleged that the victim was caught red handed in an inappropriate condition. The present petitioner was an eye witness to such incident and he narrated the same in the salishi meeting. After such meeting the victim committed suicide. Investigation of the case is yet to conclude. 10. As to how far the present petitioner is responsible for the suicide committed by the victim is to be considered at the trial on the basis of the evidence to be adduced by the prosecution. 11. Under such circumstances and considering the aforesaid facts and circumstances as well as the materials in the case diary, the prayer of the petitioner for anticipatory bail is allowed. 12. Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs. 10,000/- (Rupees ten thousand only) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and Page 3 subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on condition that the petitioner will report before the Investigation Officer once in a fortnight till the conclusion of the investigation and on condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without reference to this Court. 13. Accordingly, C.R.M. (A) 2492 of 2026 is disposed of. (Md. Shabbar Rashidi J.)
