Kalam Ms. Bhaswati Lahiri …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 1st Additional Court at Alipore, to dispose of the Title Suit no. 23677 of 2014, expeditiously. The learned advocate appearing for the petitioner submits that 4th August, 2026 was fixed for hearing of the ex parte vacating petition and the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure. He submits that since the Presiding Officer was on leave on that date, the hearing of the said application could not be taken. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division), 1st Additional Court at Alipore, to take up hearing of the application for vacating the order fixing the suit for ex parte hearing and the application under Order 39 Rule 1 & 2 of the Code of Civil Procedure, if the same are 2 otherwise ready for hearing and to dispose of the same as expeditiously as possible without grating any unnecessary adjournment to either of the parties. After disposal of the aforesaid applications, the learned trial judge shall make an endeavour to dispose of the Title Suit 23677 of 2014 as expeditiously as possible keeping in mind that the suit is pending from the year 2014.
