2. Mr. G.S. Negi, Additional Chief Standing Counsel for the State of Uttarakhand.
3. Petitioner is serving on daily wages in Forest Department at Rudraprayag since
1998. According to him, Mr. Jaipal Singh, who was engaged in the same Forest Division in 2006, is being paid minimum of pay scale; while, petitioner is still paid daily wages and not minimum of pay scale. This, according to
learned counsel for the petitioners is unjust, as senior employee cannot be deprived of benefit of minimum of pay scale. Learned counsel for the petitioner submits that petitioner has also earned a right to be considered for regularisation against available vacancy.
4. Learned State Counsel, submits that if petitioner has any grievance, then he can approach the competent authority by making a representation.
5. The writ petition is, accordingly,
disposed of by permitting petitioner to make representation to the competent authority, within two weeks from today. Petitioner may also claim regularisation. If petitioner makes representation within stipulated time, decision thereupon shall be taken, as per law, within three months thereafter.
