Kausik (Rejected) CRM (M) 1230 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Baranagar Police Station Case No. 104/2026 dated 31.03.2026 under Sections 69/351(3)/61/3(5) of the BNS, 2023. And In the matter of : Anirban Bhattacharjee ……Petitioner. Mr. Gurudas Mitra Mr. Utsav Dutta ….for the State. Petitioner was arrested on 01.04.2026 and since then he is in custody. Learned advocate for the State opposes the prayer for bail and has drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS. Prima facie, it appears that this petitioner forced upon the victim and circulated obscene photographs. Having considered the stage of the case, that very recently charge sheet has been submitted, at this stage, prayer for bail of the petitioner is refused. Petitioner will renew his prayer for bail after the evidence of the victim is over before the learned Trial court. 2 Accordingly, CRM (M) 1230 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
