Civil Misc. Appeal No.2982/2008 to its original number, as the appeal was dismissed for want of compliance of the pre-emptory order dated 08.04.2025. The instant restoration application has been submitted with an inordinate delay of 256 days along-with an application under Section 5 of the Limitation Act seeking condonation of delay. Since, there is a great delay in filing the instant restoration application, this Court is not satisfied with the reasons explained therein, but looking to the fact that important questions of law and facts are involved in the main appeal submitted against the impugned judgment, the application under Section 5 of the Limitation Act as well as the instant restoration application stand allowed, with the direction to the applicant-appellant to deposit a cost amount in the sum of Rs.2500/- (Rupees Twenty Five (2 of 2) [CRES-140/2026] Hundred only) in the “Junior Advocates Welfare Fund for purchasing of Law Books” with the Rajasthan High Court Bar Association, Jaipur within a period of two weeks from today. The amount so deposited by the appellant, would be utilized for providing law books to the young budding lawyers, who are having less than five years of practice at Bar. In case, the receipt of the cost amount i.e. Rs.2500/- is furnished by the applicant-appellant in the Office, the Registry is directed to restore the S.B. Civil Misc.
