This application has been preferred by the appellant for condoning a delay of 07 days in filing the appeal. Having been satisfied with the reasons assigned in this application, the delay of 07 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of. Cr. Appeal (DB) No. 361 of 2026 This appeal is directed against the order dated 19.01.2026 passed by the learned District and Additional Sessions Judge-I, Khunti in Misc. Criminal Application No. 19 of 2026, arising out of Arki PS Case No. 11 of 2011, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that there was an exchange of firing between the police personnel and the extremists and as a result of which, two of the police personnel had sustained some injuries. Submission has been advanced by the learned counsel for the appellant that though the appellant is named in the First Information Report but the same is based on secret information. It has been submitted that no incriminating article was recovered from the possession of the appellant and he is in custody since 05.05.2025. Learned counsel adds that one of the co-accused Krish Munda has been granted bail by a co- ordinate Bench of this Court in Criminal Appeal (DB) No.25 of 2026. Learned A.P.P. has opposed the prayer for bail of the appellant. Regard being had to the fact that the appellant has been implicated primarily on the basis of suspicion and the fact that one of the co-accused has been granted bail, as noted above, we while setting aside the order dated 19.01.2026 passed by the learned District and Additional Sessions Judge-I, Khunti in Misc. Criminal Application No. 19 of 2026, arising out of Arki PS Case No. 11 of 2011, direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-I, Khunti in connection with Arki PS Case No. 11 of 2011, corresponding to S.T. No. 38 of 2016A, subject to the condition that the appellant shall remain physically present before the learned trial Court on each and every date till the conclusion of the trial unless prevented by sufficient cause.
