Rakib (Partly Allowed) CRM (A) 1727 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gangarampur Police Station case no. 22 of 2025 dated 09.01.2025 under Sections 310(2)/311/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Sabir Ahamed @ Sk. @ Sabir Ahmed & Anr. ……Petitioners. Mrs. Jeenia Rudra Mr. Rishav Deb Barman .....for the Petitioners. Mr. Krishnendu Bhattacharyaa, Ld. APP Mr. Mukesh Kr. Gupta ……for the State. Learned advocate appearing for the petitioners submit that petitioner are innocent and they have been falsely implicated in connection with the instant case. Learned Additional Public Prosecutor submits that both the petitioners are the owner of the godown there were recoveries of the stolen properties. There are overt acts of the present petitioner no.1 who had driven vehicle which was used for alleged commission of offence. Having considered the different complicity of the two petitioners, I am of the opinion that so far as the petitioner no.1 namely, Sabir Ahamed @ Sk. @ Sabir Ahmed is concerned, his prayer for anticipatory bail be rejected. 2 However, having considered that charge-sheet has been submitted, I am of the opinion that the prayer for anticipatory bail of the petitioner no.2 namely, Faruk Hossain @ Faruk Sk @ Rejaul Hoque be allowed. As such, in the event of arrest, the petitioner no.2 shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since, charge-sheet has already been submitted before the jurisdictional Court this order of anticipatory bail of petitioner no.2 shall remain in force for a period of six weeks from date. With the aforesaid observations, CRM (A) 1727 of 2026 is partly allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
