Learned advocate appearing for the petitioners submits that the petitioner no.1 is the mother-in-law, petitioner nos.2 and 3 are the sisters-in-law (wife of the brothers-in-law) and the petitioner no.4 is the married sister-in-law. It has been submitted that the deceased committed suicide and the complaint which was lodged with the police station roped in whole of the family members without any foundation. The husband of the deceased was arrested and has been subsequently released on bail. Charge-sheet has already been submitted before the jurisdictional court, as such, petitioners may be granted relief of anticipatory bail. Learned advocate for the State opposes the prayer for anticipatory bail and produces the case diary. I have taken into account the postmortem report as well 2 as the attending materials appearing in the case diary. So far as the merit of the case is concerned, the same is uncalled for at this stage to be adjudicated upon. However, on an overall assessment, I find that custodial detention of the present petitioners, who are all ladies, are unwarranted as charge-sheet has already been submitted before the jurisdictional court. As such, the prayer for anticipatory bail of the petitioners is allowed. Accordingly, in the event of arrest, the petitioners, namely, Kalpana Bag, Priya Bag, Anita Bag and Atasi Bag shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. Thus, CRM(A) 1823 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
