Kausik CRM (M) 1273 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nalhati PS Case No. 135 of 2023 dated 24.04.2023 under section 302, 34 and 120B of the Indian Penal Code, 1890 (Section 103(1), 3(5) and 61(2) of the BNS, 2023). And In the matter of : Tarak Nath Karmakar @ Taraknath Karmakar ……Petitioner. Mr. Souvik Ganguly ……for the Petitioner. Mr. Gouranga Kumar Das Mr. Arnab Sau ….for the State. Learned advocate appearing for the petitioner submits that 28 prosecution witnesses have been completed and there has been no progress in the trial of the case for the last one year. State submits that case is at the final stages and petitioner is thickly connected with the evidence. Be that as it may, petitioner is in custody already for 3 years and 3 months, as a matter of last chance, prosecution is directed to complete all the witnesses (which are two in number) within a period of 3 months. 2 If after the aforesaid time period is over and in spite of co-operation extended by the accused, the evidence of prosecution witnesses are not complete, learned Trial court would release the petitioner on bail on such conditions as it deems fit and proper for ensuring further appearance. Prayer for bail at this stage before this Court is dismissed. Learned Trial Court would adhere to the directions passed above. Consequently, CRM (M) 1273 of 2026 is disposed of. Memo of evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
