1. Memo of evidence submitted be kept with the record. 2. The present petitioner is alleged to have extracted Rs. 1,70,000/- from the de facto complainant and his wife on the plea of getting their land mutated. Such mutation was never done. 3. Learned advocate for the petitioner submits that the petitioner was served with a notice under Section 35(3) of the BNSS and that has been duly complied with by the petitioner. He further submits that charge-sheet has not yet been submitted in the instant case. 2
4. Under such circumstances, considering the nature of allegations and on perusal of the case diary, the prayer for anticipatory bail of the petitioner is allowed. 5. In the event of arrest, the petitioner namely, Partha Pratim Dutta, shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further conditions that the petitioner shall cooperate with the investigation till submission of report in final form and on further conditions that the petitioner shall appear on each and every date before the Jurisdictional Court. The petitioner shall also not threaten or intimidate the witnesses or tamper with the evidence. 6. In the event, the petitioner fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. 7. With the aforesaid observation, C.R.M. (A) 2416 of 2026 is disposed of. 8.
