Mr. Amitabh Shukla … for the WBSEDCL. 1. Affidavit of service filed in Court today is taken on record. 2. None appears for the private respondent despite service. It is noticed that the private respondent remained unrepresented on August 4, 2026 as well as August 13, 2026. He remains unrepresented even today. 3. The petitioner complains of inaction on the part of the respondent WBSEDCL authorities in removing the electricity line from the present place to a different place as the said line is passing over the petitioner’s property. 4. Mr. Saha, learned advocate appearing for the petitioner submits that the petitioner had applied for removal/shifting of the electricity line from over the petitioner’s property to a different place as far as back on December 24, 2019 but no action has been taken by the respondent WBEDCL authorities. 5. Mr. Shukla, learned advocate appearing for the respondent WBSEDCL authorities submits that the respondent WBSEDCL authorities are ready and willing to shift the electricity line from over the petitioner’s property to a different place at the cost of the petitioner and that the respondent WBSEDCL Limited has also been able to find out an alternative route therefor but they could not execute the job in view of the objection raised by the private respondent. 6. Having heard the learned advocates appearing for the respective parties and having considered the material on record, this writ petition is disposed of by directing the respondent WBSEDCL authorities to remove the electrical line from over the petitioner’s property and place the same at/over the alternative route found out by the respondent WBSEDCL authorities within four weeks from the date of the petitioner paying the requisite charges therefor. 7. In case, the WBSEDCL authorities face any resistance in such removal, the respondent WBSEDCL authorities would be entitled to approach the respondent no.4 (i.e. the Superintendent of Police Baruipur Police District, Commercial Complex) seeking police assistance. If the respondent WBSEDCL authorities approach the 2 respondent no.4, the said respondent would provide adequate police assistance to the respondent WBSEDCL authorities to enable them to shift the electricity line from over the petitioner’s property to the alternative place found out by the respondent WBSEDCL authorities. Costs for such police assistance will be borne by the petitioner. 8. With the above observations, WPA 7874 of 2026 stands disposed of. There shall be no order as to costs. 9. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.) 3
