Accused in Crime No.36/2026 registered by BEML Nagar Police Station, KGF, for offence punishable under Sections 74, 75, 115(2) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS, 2023'), is before this Court in this criminal petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, (for short ‘BNSS, 2023’) seeking regular bail. 2. Heard learned counsel appearing for the petitioner and learned HCGP appearing for the respondent-State. 3. FIR in Crime No.36/2026 was registered by the BEML Nagar Police Station for the aforesaid offences against the petitioner herein based on the first information dated 14.06.2026 received from Vanitha.M, who is the alleged - 3 - HC-KAR CNR: KAHC010533822026 NC: 2026:KHC:42179 CRL.P No. 11722 of 2026 victim in this case. During the course of investigation, the petitioner was arrested on 15.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Criminal Misc.No.587/2026 was rejected on 15.07.2026. Therefore, he is before this Court. 4. Allegation against the petitioner is that on 14.06.2026, he had come near the house of the victim enquiring about her husband. Though he was informed by the victim that her husband was not inside the house, the petitioner allegedly had asked for some food to eat. After the victim served the food, under the pretext of washing his hands, petitioner had gone inside and thereafter, tightly hugged the alleged victim and misbehaved with her. It is under these circumstances, FIR was registered against the petitioner for alleged offences. 5. Investigation of the case is now completed. Charge sheet is filed against the petitioner, who is aged 50 years. - 4 - HC-KAR CNR: KAHC010533822026 NC: 2026:KHC:42179 CRL.P No. 11722 of 2026 Considering the nature of allegations found against the petitioner and the period of punishment for the alleged offences, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order: ORDER The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.36/2026 registered by BEML Nagar Police Station, KGF, for offence punishable under Sections 74, 75, 115(2) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court - 5 - HC-KAR CNR: KAHC010533822026 NC: 2026:KHC:42179 CRL.P No. 11722 of 2026 unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE DM List No.: 1 Sl No.: 17
