02/27.01.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Tisri P.S. Case No.84/2024, registered for the offence under Sections 292, 318(4), 338, 336(3), 340(1) of the BNS, Section 47(a) of the Excise Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Giridih.

Learned counsel appearing for the petitioner submits that the petitioner is the driver of Bolero vehicle. She further submits that the allegations are made that on the said vehicle, foreign liquors were being carried. She then submits that the petitioner earns his livelihood by driving the vehicle. She next submits that the said vehicle was being driven by the petitioner on the instruction of owner. She also submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 14 of this application.

Learned counsel appearing for the State opposed the prayer and submits that illegally the foreign liquors were being carried on the said vehicle.
5. Considering that the petitioner is the driver and it has been pointed out that the said vehicle was being driven by the petitioner on the instruction

of the owner of the vehicle and the petitioner is having no criminal antecedent, as disclosed in paragraph 14 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih in connection with Tisri P.S. Case No.84/2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
