Heard learned counsel for parties. 2. The petitioner before this Court is presently serving as an Accountant in the Office of Divisional Forest Officer, Kamrup East Division, Guwahati. The petitioner is aggrieved that he filed a representation dated 05.01.2026 before the Principal Chief Conservator of Forest and Head of Forest Force, Panjabari, Guwahati with a request to consider him for promotion to the next higher post of Head Assistant under the reserved quota available for the persons with disability. 3. The claim of the petitioner is that as per the notification issued, 4% reservation is earmarked for eligible candidates belonging to the category of persons with disability for promotion to the higher post. 4. The learned counsel for the petitioner submits that the writ petitioner is a person with disability having locomotor disability of 40%. The learned counsel for the petitioner therefore submits that in the promotion which are likely to be considered by the Department for the post of Head Assistant, the case of the petitioner be also considered in the category reserved for persons with disability. The learned counsel for the petitioner also submits that the representation which was filed as far back as 05.01.2026 has not been disposed of. 5. The learned Standing Counsel appearing for the Forest Department on the other hand submits that the prayer of the writ petitioner can be considered by the respondent authority. Page No.# 3/3
6. In view of such submissions made at the bar, this Court is of the view that the writ petition can be disposed of at this stage. 7.
Considering the limited prayer made by the writ petitioner, the writ petition is disposed of without issuance of notice and without expressing any opinion on merit. 8. The writ petition stands disposed of directing the Principal Chief Conservator of Forest and Head of Forest Force, Panjabari, Guwahati to expeditiously consider the representation dated 05.01.2026 filed by the writ petitioner and pass appropriate orders thereon. If the petitioner is found to be eligible for being considered in the reservations earmarked for the category of persons with disability, then the case of the petitioner should also be considered by the DPC, which will be constituted for considering cases for promotion to the next higher post of ‘Head Assistant’ in the Office of Divisional Forest Officer, Kamrup. 9. In that view of the matter, the writ petition stands closed and disposed of. 10. The learned respondents are directed to expeditiously consider the dispose of the application within the outer limit of 60 (sixty) days from the date of receipt of certified copies of the order.
