24.08.2026 Court No.35. D/L.600. Rakib (Rejected)
CRM (A) 2724 of 2026
In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tehatta Police Station case no. 478 of 2026 dated 31.05.2026 under Sections 3/4/5/7/8 of the Immoral Traffic (Prevention) Act, 1965.
And In the matter of : Basudeb Paul @ Pal.
……Petitioner. Mr. Milon Mukherjee, Sr. Adv, Mr. Amanul Islam Mr. Sourav Mukherjee Mr. Gourav Roy
.....for the Petitioner. Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick
……for the State.
Learned senior advocate appearing for the petitioner submits petitioner is innocent and has been falsely implicated in the instant case. Learned advocate appearing for the State opposes the prayer for anticipatory bail. Records of the case reflect that petitioner is the owner of the Relax Restaurant and Bar. Having considered the nature of the accusations, I am of the view that this is not a fit case for granting anticipatory bail. However, if the petitioner appears and surrender before the jurisdictional Court and prays for regular bail, learned jurisdictional Court will independently consider the regular bail without being influenced by any observations of this Court. Accordingly, CRM (A) 2724 of 2026 is dismissed.
2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
