The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.618/2025, registered at Police Station City Kotwali, District-Bilaspur (C.G.) for alleged commission of offence punishable under Section 305(a) of BNS. Case of the prosecution, in brief, is that on 12/11/2025 a written complaint was lodged by Mrs. Balvinder Kaur alleging that on 03/07/2023 complainant took her husband for treatment to Mumbai then the present applicant who is the son of complaint's sister often came to complainant's house to sleep over night. It is further alleged, few days before complainant found missing her 2 gold bindis, 4 gold rings, 1 gold bracelet, 1pair of gold earrings, 6 gold bangles, 1 broad bangle, and 10 pair of silver anklets, 10 pairs of silver toe rings some silver coins and other silver jewelries during that period it is suspected that the present applicant stole the gold and silver jewelry in their absence. Therefore offence was registered against the applicant.

Learned counsel for the applicant submits that there was a family dispute between the applicant and family of the complainant on account of which the present FIR has been lodged. It is stated that the complainant had gone to Mumbai for treatment of her husband and the applicant happens to be the nephew of the complainant and it is highly improbable that the incident which has taken place between 03/07/2023 to 26/09/2024 the FIR of the same has been lodged on 12/11/2025 stating that some ornaments of the complainant which was kept in her almirah was found missing and she suspected that it was the applicant who had stolen the same. He would submit that the applicant is permanent resident of above-mentioned address and as such there is no chance of his absconding, the applicant is ready to furnish adequate surety and shall abide by all the directions and conditions which may be imposed by this Court, therefore he prays to enlarge the applicant on anticipatory bail.

4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the materials available on record.
6. Considering the facts and circumstances of the case, submission of
learned counsel for the parties, materials available on record, further considering the fact that it is a case of theft of gold and silver ornaments from the almirah of the complainant when the complainant had gone to Mumbai for treatment of her husband and the applicant who happens to be the nephew of the complainant used to sleep in their house in their absence, considering the fact that the ornaments are still missing and investigation is still going on, therefore I am not inclined to grant anticipatory bail to the present applicant.

Accordingly, the anticipatory bail application of the applicant - Gurvinder Singh Bhatiya, involved in Crime No.618/2025, registered at Police Station City Kotwali, District-Bilaspur (C.G.) for alleged commission of offence punishable under Section 305(a) of BNS is rejected.
