In Re : Rahidul Haque @ Bonu ... Petitioner.
Mr. Kaushik Choudhury, Mr. Dwaipayan Panda
... For the Petitioner.
Mr. Kallol Mondal, Ld. PP, Mr. Bikash Kumar Singh
... For the State.
Mr. Amit Roy
... For the de facto complainant.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 3 months. It has been submitted that there is no possibility of the trial concluding very soon. Learned advocate submits that petitioner be released on bail on any stringent condition. Learned advocate appearing for the de facto complainant submits that it is the present petitioner who assaulted the victim resulting in his death. Learned Public Prosecutor appearing for the State opposes the prayer for bail and submits that trial has been progressing smoothly, 14 witnesses have already been examined and prosecution intends to examine seven more
2 witnesses in support of its case; most of the witnesses presently are formal witnesses. Having considered the manner in which the trial is progressing, I am of the opinion that the rhythm of the trial should not be jeopardized. As such, the prayer for bail of the petitioner is rejected at this stage. The application for bail, being CRM (M) 1265 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
