In Re : Nasima Khatun @ Nasima Bibi @ Nasmina Bibi ... Petitioner.
Mr. Tapodip Gupta, Ms. Usashi Chattopadhyay
... For the Petitioner.
Mr. Rajendra Banerjee, APP, Mr. Koustav Lal Mukherjee
... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody since 26.10.2025, charge- sheet has already been submitted and as other accused persons are not before the Court, there is no possibility of the trial commencing in near future. As such, petitioner being a lady be granted bail on any condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that it is this petitioner who strangulated the deceased while she was in ambulance. Having regard to the complicity of the present petitioner and the fact that other accused persons are absconding, I am not inclined to release the petitioner on
2 bail at this stage. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1241 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
