NIKITA JAIN Digitally signed by NIKITA JAIN Date: 2026.09.11 13:06:56 +0530 2 Hon’ble Shri Justice Amitendra Kishore Prasad Judgment on Board 09/09/2026 1. The present writ petition has been filed by the petitioner seeking a direction to the respondent authorities for release and disbursement of the amount of the final installment pertaining to the construction works executed by the petitioner during his tenure as Sarpanch of Gram Panchayat Bhatmaahul, Janpad Panchayat Jaijaipur, District Sakti. 2. Learned counsel for the petitioner submits that the petitioner, during his tenure as Sarpanch of Gram Panchayat, Bhatmaahul, Janpad Panchayat Jaijaipur Distric Sakti, has executed various construction works and submitted his final bill amounting to Rs.17,88,594/- (Rupees Seventeen Lakh Eighty-Eight Thousand Five Hundred Ninety-Four only) which has been duly recognized by the respondent authorities and a recommendation for payment of aforesaid amount has also been made by the competent authority. However, despite the amount having already been received from the concerned department, the same has not been disbursed to the petitioner till date and is lying pending on account of Gram Panchayat. Bhatmaahaul. Counsel for the petitioner further submits that from a perusal of the letter dated 25.02.2026, it appears that the Chief Executive Officer, District Panchayat, Sakti has already written letter to the concerned Sarpanch and the Secretary of concerned Gram Panchayat has received the said letter. 3. Having considered the submissions advanced by learned counsel for the parties and upon perusal of the material available on record, this Court finds that the grievance of the petitioner is confined to non- 3 disbursement of the amount pertaining to the final installments of the construction works allegedly completed during his tenure as Sarpanch. 4. The record prima facie demonstrates that the competent authorities have undertaken physical verification of the construction works and the inspection team has found the works to have been completed at the respective sites. The fact that the works are being utilised by the residents of Gram Panchayat Bhatmahul has also been recorded in the inspection report. It is also significant that the amount claimed by the petitioner has not been finally disallowed by the competent authority. On the contrary, directions have already been issued for ensuring payment of the final instalment amounting to Rs.17,88,594/- in accordance with the applicable rules. 5. In view of the aforesaid circumstances, this Court is of the considered opinion that the present writ petition can be disposed of by directing the competent authority to take the matter to its logical conclusion within a stipulated period. 6. Accordingly, the writ petition is disposed of with the following directions: (i) The Chief Executive Officer, District Panchayat, Sakti, shall ensure compliance with the communication/order dated 25.02.2026 and shall take all necessary steps for verification and disbursement of the amount of Rs.17,88,594/- claimed by the petitioner towards the final instalments of the completed construction works, strictly in accordance with law and the applicable rules. (ii) If there is no legal, financial, technical or other statutory impediment in releasing the aforesaid amount, the same shall 4 be disbursed to the petitioner within a period of 30 days from the date of receipt of a certified copy of this order. (iii) In case any impediment is found in making payment of the aforesaid amount, the competent authority shall record specific reasons for the same and communicate a reasoned decision to the petitioner within the aforesaid period. (iv) The concerned Chief Executive Officer, District Panchayat, Sakti, shall submit a compliance affidavit before the Registrar (Judicial) of this Court within the aforesaid period, indicating the action taken pursuant to this order and the status of disbursement of the amount claimed by the petitioner. With the aforesaid observations and directions, the writ petition stands disposed of. Sd/- (Amitendra Kishore Prasad) JUDGE Nikita
