This is an application for appointment of an Arbitrator under Section 11(6) of the Arbitration and Conciliation Act, 1996 (for brevity ‘Arbitration Act’). 3. Notices have been issued to Respondent Nos. 1, 2 & 3 and Mr. Agrawal, learned counsel represents them. He submits that since there exists a dispute arising out of an agreement and there is an arbitration clause in the said agreement at Clause 16 for appointment of an Arbitrator. Hence, the dispute may be referred to the sole Arbitrator. 4. Clause 16 of the Agreement is quoted herein under : “16. यह कि, प्रथम पक्ष एवं कितीय पक्ष े मध्य उपरोक्त आपसी सहमतित पत्र े संबंध में ोई भी वाद-किववाद किसी भी स्वरूप में, दशा में, स्थिस्थतित में उत्पन्न व कि(र्मिमत हो(े पर उक्त ा कि(रारण मध्यस्थता एवं सुलह अतिधकि(यम 1996 े अ(ुरूप पूण/ किया जावेगा उक्त े सु(वाई ा क्षेत्रातिधार रायपुर (छ.ग.) होवेगा जिजस हेतु बतौर मध्यस्थ े रूप में प्रथम पक्ष े तरफ से श्री शेखर सराफ किपता श्री रामअवतार सराफ कि(वासी फ्लै ट (ं. बी-401 रोमे(ेस्क्यु किवला लाभांडी रायपुर तह. व जिजला रायपुर (छ.ग.) एवं कितीय पक्ष े तरफ से श्री खेमराज चन्द्रार किपता स्व. Clause 16 of the agreement quoted herein above indicates that two named Arbitrators (one by each of the party) may be appointed for resolving any dispute arising out of the said 3 Agreement. But, after issuance of notices, none of the named Arbitrators responded to the same, hence, this application has been filed under Section 11(6) of the Arbitration Act for appointment of Arbitrator. 6. Mr. Agrawal, learned counsel for respondent Nos. 1 to 3 has no objection for appointment of Arbitrator. 7. Both of them agreed for appointment of Mr. Justice Gulam Minhajuddin, a retired Judge of this High Court to be appointed as sole Arbitrator to arbitrate the dispute. 8. Hence, on consent of learned counsel for the parties, Mr. Justice Gulam Minhajuddin is appointed as the sole Arbitrator to arbitrate the dispute. 9. Relevant records shall be sent to Mr. Justice Gulam Minhajuddin for necessary action at his end. 10. The remuneration of the Arbitrator shall be settled with the mutual consent of the parties. 11.
