… Petitioner(s)
Mr. Amitabha Ghosh Ms. Arpita Das Pal Mr. Buddhadeb Chatterjee
… for the petitioner(s)
Mr. Subrata Mukherjee Mr. Neel Chakraborty
… for the State-respondent(s)
Learned advocate for the petitioners submits that the petitioners are innocent and they have been falsely implicated in connection with the instant case because of change in administration. Learned advocate for the State categorically opposes the contention and submits that the petitioners in an organized manner threatened the complainant and extorted money from him. I have taken into account the fact that the date of incident referred to in the complaint is one year prior to the information being furnished to the police station.
2 Having considered the overall circumstances, I am of the view that although the investigation may continue but custodial detention of the present petitioners may not be warranted. Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Sukanta Mondal, Tanmoy Sarkar, Arjun Kumar Roy @ Jhantu, Sanjit Roy, Jatin Roy, Dhiren Sarkar, Pritam Sarkar, Panchanan Kirtania, Bapan Mondal, Sankar Murmu, Susanta Mondal, Ranjit Roy, Sukumar Kha] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioners shall meet with the investigating officer of the case within ten days from date, thereafter, on all subsequent dates as would be fixed by the Investigating Officer of the case. Accordingly, CRM (A) 1830 of 2026 is disposed of. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
