Learned advocate for the petitioner submits that the petitioner has been implicated in the instant case because of family rivalry. Learned advocate for the State, on the other hand, opposes the prayer for bail and produces the Statement of the victim under Section 164 of the Cr.P.C. Learned advocate for the defacto-complainant also opposes the prayer for bail. I have taken into account the statement before the learned Magistrate as well as the deposition in court by the victim girl in course of evidence of the case. Having considered that the victim girl is of very tender age of about 10 years and that she has been
2 consistent in her statement before the learned Magistrate on an incident of earlier date and narrated the chronology of events before the learned trial court, I am of the view that this is not a fit case for releasing the petitioner on bail as the offence prima facie seems to assume heinous character. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM(M) 2029 of 2025 is dismissed. Pending application(s), if any, is also disposed of.
