JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused in Crime No.164/2026 registered by K. R. Pet Rural Police Station, Mandya, for the offences punishable under Sections 109, 352, 351(2), 118(1) and 126(2) of BNS, 2023 and Section 27(1) of the Arms Act, 1959, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.164/2026 was registered by K. R. Pet Rural Police Station, Mandya, for the aforesaid offences against the petitioner herein based on the first information dated 26.05.2026 received from Smt. Vinoda, mother of injured victims in the present case. During the course of investigation, petitioner was arrested on 27.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5181/2026 was rejected on 11.06.2026. In the first information submitted on 26.05.2026 at about 14.30 hours, in respect of the alleged incident that had taken place on 25.05.2026 at about 07.00 hours, it is stated that petitioner had ill-will against the injured victims in the present case, who are the sons of the first informant, after they had fought against each other earlier in a village festival. On 25.05.2026 at about 07.00 a.m., petitioner allegedly abused the sons of the first informant and thereafter, assaulted them with a deadly weapon. 5. In respect of the alleged incident that had taken place at about 07.00 a.m. on 25.05.2026, first information is submitted after a lapse of more than 24 hours. Material on record would go to show that there is a case and counter case registered in respect of very same incident by K. R. Pet Rural Police Station in Crime No.164/2026 and Crime No.165/2026. The wound certificate of the injured victims made available to this Court would go to show that all the victims have suffered only simple injuries in the incident in question. Petitioner is in custody for the last more than two months. Major portion of the investigation is completed. The petitioner is directed to be enlarged on bail in Crime No.164/2026 registered by K. R. Pet Rural Police Station, Mandya, for the offences punishable under Sections 109, 352, 351(2), 118(1) and 126(2) of BNS, 2023 and Section 27(1) of the Arms Act, 1959, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR CNR: KAHC010428292026 NC: 2026:KHC:40135 CRL.P No. 9150 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
